IPC Sweepstakes Rules

OFFICIAL RULES
EDUCATION REFERRAL CAMPAIGN SWEEPSTAKES

NO PURCHASE, PAYMENT OF ANY KIND, OR SUBSTANTIAL TIME OR EFFORT IS NECESSARY TO ENTER OR WIN THE EDUCATION REFERRAL CAMPAIGN SWEEPSTAKES.  

SPONSORMCHC-Chicago Hospital Council d/b/a the Illinois Poison Center (IPC” or “Sponsor) 1151 E Warrenville Road, Naperville, Illinois 60566.

SWEEPSTAKES: The IPC’s Education Referral Campaign Sweepstakes (“Sweepstakes”) includes two separate random prize drawings: (1) the course taker drawing (the “Course Taker Drawing”) and (2) the referral source drawing (the “Referral Source Drawing”).  

SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begin at 12:00:01 AM Central Time (“CT”) on Sunday, September 1, 2024 and ends at 11:59:59 PM CT on Thursday, October 31, 2024 (the “Sweepstakes Period”). Sponsor’s computer is the official clock for this Sweepstakes.

ELIGIBILITY: The Sweepstakes is only open to participants that are legal residents of the U.S., living or working in Illinois, before the Sweepstakes Period ends. Void outside the U.S. and wherever else prohibited by law. Employees of Sponsor and its Affiliated Entities (defined herein) and their immediate family members (spouse, parents, children and siblings, and their respective spouses) and persons living in the household of each are not eligible to participate.  The term “Affiliated Entities” means any other entity that is now or hereafter, directly or indirectly, owned or controlled by, controlling, or under common ownership or control with, managed by, under an affiliation contract (such as a joint venture or partnership) with the IPC or any other Affiliated Entity. All federal, state and local laws and regulations apply.

ENTRY: There are two (2) methods to enter the Course Taker Drawing and two (2) methods to enter the Referral Source Drawing.

Course Taker Drawing Method #1. To enter the Course Taker Drawing, eligible participants must complete the IPC’s free, online Poison Prevention Education Course (“PPEC”) for the first time during the Sweepstakes Period (“Course Takers”). Eligible participants who have completed the PPEC at any time prior to the Sweepstakes Period will not qualify through this method of entry regardless of whether they complete the PPEC during the Sweepstakes Period. It must be the first time an eligible participant completes the PPEC and it must be during the Sweepstakes Period in order for the eligible participant to qualify as a Course Taker.  The PPEC is free and can be accessed through the IPC website. Eligible participants are required to provide all information requested when registering to take the PPEC. If identifying a referral source, eligible participants are certifying that they have received consent from the referral source for their identification to Sponsor and that they are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy (see “Privacy” below). Eligible participants that register for the PPEC will be assigned a Poison Prevention Education Resource Center (“PPERC”) ID. Course Takers will receive one (1) entry into the Course Taker Drawing. Limit one (1) entry per PPERC ID.  

Course Taker Drawing Method #2. To enter the Course Taker Drawing without completing the PPEC, eligible participants must hand print their name, complete address, city, state, zip code, daytime phone number, birth date, and e-mail on a single, letter size sheet of paper (i.e., 8.5 by 11 inches) and place inside an envelope and mail it to: Illinois Poison Center ATTN Sweepstakes, 833 W. Jackson Blvd., Suite 610, Chicago, Illinois 60607 (“Alternate Method of Entry” or “AMOE Entry”). A participant’s AMOE Entry must be postmarked on a date that is within the Sweepstakes Period to be eligible. Limit one (1) AMOE Entry per participant.  AMOE Entries that are mutilated, illegible or incomplete are not eligible. All entries received become the sole property of Sponsor and will not be returned. Sponsor will not be responsible for illegible, late, lost, mutilated, misdirected, postage due or stolen manual entries. Information submitted through an AMOE Entry is subject to Sponsor’s Privacy Policy (see “Privacy” below).

Referral Source Drawing Method #1. To enter the Referral Source Drawing, Course Takers must identify eligible participants by name and valid email address as their referral source when the Course Taker registers for the PPEC (“Identified Referral Source”). By actively referring eligible participants or consenting to be identified as a referral source, such referral sources are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy (see “Privacy” below). Identified Referral Sources will receive one (1) entry into the Referral Source Drawing for each Course Taker identifying them as their referral source. Limit one hundred (100) entries per Identified Referral Source.  

Referral Source Drawing Method #2. To enter the Referral Source Drawing without being an Identified Referral Source, eligible participants must hand print their name, complete address, city, state, zip code, daytime phone number, birth date, and e-mail on a single, letter size sheet of paper (i.e., 8.5 by 11 inches) and place inside an envelope and mail it to: Illinois Poison Center ATTN Sweepstakes, 833 W. Jackson Blvd., Suite 610, Chicago, Illinois 60607 (“Alternate Method of Entry” or “AMOE Entry”). A participant’s AMOE Entry must be postmarked on a date that is within the Sweepstakes Period to be eligible. Limit one hundred (100) AMOE Entries per participant. AMOE Entries that are mutilated, illegible or incomplete are not eligible. All entries received become the sole property of Sponsor and will not be returned. Sponsor will not be responsible for illegible, late, lost, mutilated, misdirected, postage due or stolen manual entries. Information submitted through an AMOE Entry is subject to Sponsor’s Privacy Policy (see “Privacy” below).

OVERALL LIMITATIONS: Limit one (1) Entry per PPERC ID or one (1) AMOE Entry for the Course Taker Drawing. Limit one hundred (100) entries total as an Identified Referral Source or as a participant through an AMOE Entry for the Referral Source Drawing.

RANDOM DRAWINGS: The Sponsor will select one (1) potential winner of the Grand Prize for the Course Taker Drawing and one (1) potential winner of the Grand Prize for the Referral Source Drawing from among all eligible entries received for each drawing during the Sweepstakes Period. The Sponsor will hold the drawings on Wednesday, November 6, 2024. Only one Grand Prize per person.  

Sponsor will contact the potential Grand Prize winners via email and/or phone and the potential Grand Prize winners will be required to provide their mailing address within fourteen (14) calendar days via email to a Sponsor-provided email address.  If a potential winner is deemed a minor in his or her state of primary residence, the minor’s parent(s)/legal guardian must provide their name, mailing address, and the minor potential winner’s email within fourteen (14) calendar days via email to the Sponsor-provided email address and the Grand Prize will be awarded in their name. The Sponsor will send the Grand Prize to the mailing address provided by the winners and/or the winner’s parent(s)/legal guardian within thirty (30) days of the potential winner (or his/her parent(s)/legal guardian) providing their mailing address (and, if applicable, the minor potential winner’s email), subject to Sponsor’s determination of the winner’s compliance with these Official Rules.  

If a potential winner (or his/her parent(s)/legal guardian) does not confirm their mailing address (and, if applicable, the minor potential winner’s email) within fourteen (14) calendar days, the information provided is incomplete, or Sponsor determines the potential winner(s) did not comply with these Official Rules, the potential winner(s) will be deemed by Sponsor to have forfeited the Grand Prize and an alternate potential winner will be selected in a separate random drawing. If the potential winner(s) cannot accept or receive the prize for any reason, the potential winner will be deemed by Sponsor to have forfeited the Grand Prize and an alternate potential winner will be selected in a separate random drawing.

SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.  

PRIZE/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS: Sponsor will award two (2) Grand Prizes. Each Grand Prize is a $250.00 Amazon gift card. The gift card is subject to terms contained on the gift card. All taxes, if applicable, and all other costs associated with acceptance or use of the Grand Prize, not specified herein, are the sole responsibility of the winner. The AVR of each Grand Prize is $250.00 and all Grand Prizes are $500.00. Odds of winning the Grand Prize in of each drawing will depend upon the total number of eligible entries received for each drawing during the Sweepstakes Period.  

PRIZE CONDITIONS: The Grand Prize is not redeemable for cash, assignable, or transferable. Sponsor prohibits the winner from making any substitution or exchange except if the Grand Prize is unavailable, in which case Sponsor will award a Grand Prize of equal or greater value. Any other exchange or substitution is at the sole discretion of the Sponsor. Any other incidental expenses associated with the receipt and/or use of the Grand Prize is the winner’s sole responsibility. The winners are responsible for all federal, state and local taxes, if applicable. The Grand Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledges that the Sponsor and its Affiliated Entities do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Grand Prize offered. Award of the Grand Prize is subject to Sponsor’s verification of eligibility and compliance with these Official Rules.

GENERAL RULES:  

Agreement and Release. By participating in the Sweepstakes, you (or your parent(s)/legal guardian) (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor that is final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes any person it reasonably believes has intentionally violated these Official Rules; and (ii) withdraw a Survey Entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select potential winners from among all eligible entries received prior to withdrawal without notice to the participant or Authorized Account Holder (defined below).  Participating entrants agree to these Official Rules and the decisions of the Sponsor, and release the Sponsor and its Affiliated Entities, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation in the Sweepstakes, and the acceptance and use/misuse of the Grand Prize. Winners assume all liability for any injury or damage caused or claimed to be caused by participation in the Sweepstakes or use/misuse or redemption of the Grand Prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the Grand Prize.

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY TAMPER OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Force Majeure. If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend one or both of the Sweepstakes including disqualifying any individual or participant determined by Sponsor, in its sole discretion, to have caused or attempted to have caused such tampering. In the event Sponsor disqualifies an individual, Sponsor will conduct a random drawing from among all remaining eligible entries received during the Sweepstakes Period to determine a potential winner.  

Disclaimer. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes. Sponsor is not responsible for incompatibility of entrant’s hardware, software or browser technology.  

Identity Disputes. In the event of a dispute over the identity of a participant, entry will be deemed submitted by the Authorized Account Holder of the e-mail address at time of entry subject to the eligibility rules container herein regardless of the name, date of birth, or other identifier. “Authorized Account Holder” means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof that such party is the Authorized Account Holder.  

DISPUTES: Except where prohibited, entrant agrees that all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Illinois. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Illinois without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Illinois. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
